These terms govern your access to the Mega Payments website and services. Please read them carefully.

These Terms of Service ("Terms") are a binding agreement between you and Mega Payments INC ("Mega Payments," "we," "us," or "our") and govern your use of our website at MegaPayments.com and any related services, content, and applications (collectively, the "Services"). By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least 18 years old and able to form a legally binding contract to use the Services. If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.
Mega Payments provides payment processing solutions and related products. Approval for a merchant account is subject to underwriting, applicable card network rules, and the separate Merchant Processing Agreement you enter into when you open an account. In the event of a conflict between these Terms and a signed Merchant Processing Agreement, the Merchant Processing Agreement controls for matters relating to your account.

Fees for processing and related services are described in your pricing program or Merchant Processing Agreement. You are responsible for all applicable fees, chargebacks, and assessments. We will provide notice of fee changes as required by your agreement and applicable law.
The Services, including all text, graphics, logos, and software, are owned by Mega Payments or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Services for their intended purpose. All rights not expressly granted are reserved.
The Services may integrate with or link to third-party products and websites. We are not responsible for third-party services, and your use of them is governed by their own terms.
The Services are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.
To the maximum extent permitted by law, Mega Payments will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Services.
You agree to indemnify and hold harmless Mega Payments and its affiliates from any claims, losses, or expenses arising out of your use of the Services or your breach of these Terms.
We may suspend or terminate your access to the Services at any time if you violate these Terms or if required by our partners, the card networks, or applicable law. Provisions that by their nature should survive termination will survive.
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes will be resolved in the state or federal courts located in Michigan, unless otherwise required by your Merchant Processing Agreement.
We may update these Terms from time to time. We will post the revised version here and update the "Last updated" date above. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
